Det vanligaste \u00e4r att n\u00e5gon av parterna vill \u00e4ndra hyrans storlek.<\/p>\n<h3>N\u00e4r hyresv\u00e4rden vill \u00e4ndra villkoren<\/h3>\n<p>N\u00e4r hyresv\u00e4rden s\u00e4ger upp en lokalhyresg\u00e4st f\u00f6r villkors\u00e4ndring ska upps\u00e4gningen inneh\u00e5lla:<\/p>\n<ul>\n<li>Uppgift om de villkor som beg\u00e4rs f\u00f6r att avtalet ska f\u00f6rl\u00e4ngas. Detta kan g\u00f6ras genom att ett f\u00f6rslag p\u00e5 nytt avtal skickas med.<\/li>\n<li>Information om att hyresg\u00e4sten ska v\u00e4nda sig till hyresn\u00e4mnden inom tv\u00e5 m\u00e5nader fr\u00e5n det att hyresg\u00e4sten tog del av upps\u00e4gningen, om hen inte g\u00e5r med p\u00e5 att flytta utan ers\u00e4ttning.<\/li>\n<\/ul>\n<p>Om dessa uppgifter saknas \u00e4r upps\u00e4gningen f\u00f6r villkors\u00e4ndring ogiltig. Att upps\u00e4gningen \u00e4r ogiltig inneb\u00e4r att avtalet l\u00f6per vidare p\u00e5 of\u00f6r\u00e4ndrade villkor om inte hyresg\u00e4sten ocks\u00e5 har sagt upp avtalet.<\/p>\n<p>Upps\u00e4gningen ska vara skriftlig och ska delges hyresg\u00e4sten.<\/p>\n<h3>N\u00e4r hyresg\u00e4sten vill \u00e4ndra villkoren<\/h3>\n<p>N\u00e4r hyresg\u00e4sten s\u00e4ger upp ett avtal f\u00f6r att \u00e4ndra villkoren ska upps\u00e4gningen inneh\u00e5lla uppgifter om de villkor som beg\u00e4rs f\u00f6r att avtalet ska f\u00f6rl\u00e4ngas. Upps\u00e4gningen ska vara skriftlig. Det finns inget krav p\u00e5 hur upps\u00e4gningen skickas.<\/p>\n<p>Hyresg\u00e4sten m\u00e5ste dessutom ans\u00f6ka om medling i hyresn\u00e4mnden inom tv\u00e5 m\u00e5nader fr\u00e5n upps\u00e4gningen.<\/p>\n<p>Hyresg\u00e4stens upps\u00e4gning f\u00f6r villkors\u00e4ndring \u00e4r ogiltig om n\u00e5got av f\u00f6ljande g\u00e4ller:<\/p>\n<ul>\n<li>Uppgift saknas om de villkor som beg\u00e4rs f\u00f6r avtalet ska f\u00f6rl\u00e4ngas.<\/li>\n<li>Hyresg\u00e4sten ans\u00f6ker inte om medling i r\u00e4tt tid.<\/li>\n<li>Hyresg\u00e4sten \u00e5terkallar sin ans\u00f6kan om medling innan hyrestiden har l\u00f6pt ut, om inte parterna tr\u00e4ffat ett avtal med nya villkor.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Ans\u00f6k om medling<\/h3>\n<p>\u00c4ven en upps\u00e4gning om villkors\u00e4ndring kan leda till att hyresf\u00f6rh\u00e5llandet upph\u00f6r. Om hyresg\u00e4sten och hyresv\u00e4rden inte kan enas om nya villkor upph\u00f6r avtalet vid avtalstidens utg\u00e5ng. Att hyresf\u00f6rh\u00e5llandet upph\u00f6r kan leda till ekonomisk skada f\u00f6r hyresg\u00e4sten.<\/p>\n<p>Hyresg\u00e4sten m\u00e5ste ans\u00f6ka om medling i hyresn\u00e4mnden f\u00f6r att kunna f\u00e5 fr\u00e5gan om skadest\u00e5nd pr\u00f6vad av tingsr\u00e4tten. Det g\u00e4ller oavsett vem som sagt upp avtalet. Ans\u00f6kan ska g\u00f6ras inom tv\u00e5 m\u00e5nader fr\u00e5n det att hyresg\u00e4sten tog del av upps\u00e4gningen. Om det \u00e4r hyresg\u00e4sten som sagt upp hyresavtalet ska ans\u00f6kan g\u00f6ras inom tv\u00e5 m\u00e5nader fr\u00e5n upps\u00e4gningen.<\/p>\n<p>Hyresn\u00e4mnden kan inte fatta n\u00e5gra bindande beslut i medlings\u00e4rendet.
